These Terms of Service ("Agreement") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("User," "Customer," "you"), and Imageleet Networks ("Imageleet," "we," "us," or "our"), concerning your access to and use of our web hosting services, including but not limited to Web Hosting, VPS Hosting, Dedicated Servers, Domain Registration, Email Hosting, SSL Certificates, and any other related products or services provided by Imageleet Networks Private Limited. By purchasing, accessing, or using any service provided by Imageleet, you agree to be bound by all the terms and conditions of this Agreement, including any policies, guidelines, or amendments that may be presented to you from time to time.
The Agreement begins when you electronically accept or use any service and continues in effect unless terminated in accordance with the provisions outlined below. You acknowledge that the services offered by Imageleet may require you to comply with applicable third-party terms including, but not limited to, registries, software vendors, and data processors.
You must be at least eighteen (18) years of age and able to form a binding contract under applicable law to register or use our services. You represent that the information provided to Imageleet during registration is accurate, complete, and up-to-date. You are responsible for maintaining the confidentiality of your account credentials and are liable for all activities occurring under your account. You agree to notify us immediately of any unauthorized use or breach of your account.
Imageleet offers Web Hosting, Virtual Private Servers (VPS), Dedicated Servers, and Domain Name Registration services. The nature, pricing, and technical specification of services are as detailed on our website and may be amended from time to time. Services are provided on an "as-is" and "as-available" basis. Imageleet does not guarantee uptime or availability, unless specified in a separate Service Level Agreement (SLA).
Domain registration services are subject to the terms and policies of ICANN and individual domain registries. Registration is not guaranteed until confirmed. The Customer is responsible for ensuring the accuracy of WHOIS information and renewal of domains. Domains will be locked or suspended if required by law, a dispute, or for failure to comply with these terms.
All payments are due in advance and are non-refundable except where specified by a money-back guarantee. Invoices must be settled before service activation or renewal. We reserve the right to suspend or terminate services for non-payment or chargebacks. Renewal of services is automatic unless cancelled by you prior to the renewal date. Pricing is subject to change with prior notice. Taxes applicable under Indian laws shall be levied.
The Agreement is effective on a monthly or annual basis depending on your subscription. Either party may terminate the Agreement with written notice. Imageleet reserves the right to terminate or suspend services immediately without notice in cases of violation of the Acceptable Use Policy (AUP), abuse, fraud, or non-payment. Upon termination, all data, files, and configurations stored on our servers may be deleted.
The use of Imageleet services must not violate Indian laws or the laws of any applicable jurisdiction. You may not host, transmit, or link to material deemed illegal, harmful, abusive, infringing, defamatory, or disruptive. Activities such as spamming, DDoS attacks, hacking, mining without permission, and distribution of malware are strictly prohibited. We reserve the right to suspend or terminate accounts found in violation.
Shared hosting customers must not exceed predefined usage limits related to CPU, memory, bandwidth, inode count, and storage. Continuous abuse may result in throttling, suspension, or mandatory upgrades. Customers may not run standalone server applications or engage in resource-heavy tasks without prior approval. VPS and Dedicated Server users are responsible for managing and securing their environments.
Customers are solely responsible for their content and maintaining independent backups. While Imageleet may perform periodic backups of Web Hosting accounts, this is not guaranteed, and backup integrity is not warranted. For VPS and Dedicated Server environments, the customer is responsible for setting up backup systems. Imageleet disclaims liability for any loss or corruption of data.
Any IP addresses assigned to you by Imageleet are loaned for the duration of the subscription and may be changed or reclaimed at our discretion. You may not use the IPs for illegal activities, IP spoofing, or blackhat SEO. Abuse of network resources, including but not limited to excessive bandwidth consumption or port scanning, will result in service limitations or termination.
Support is provided through ticket systems, email, or phone, as detailed on our support page. Web Hosting includes standard support. VPS and Dedicated Servers are provided unmanaged unless explicitly purchased with a managed support plan. Support is limited to server and service-related issues. Imageleet does not offer development, third-party software, or code troubleshooting.
Email hosting included with Web Hosting or purchased separately must comply with anti-spam regulations. Users must not engage in sending bulk unsolicited messages or use compromised accounts for phishing. Imageleet reserves the right to suspend accounts or domains that abuse mailing services.
Unless otherwise agreed in writing, Imageleet does not guarantee 100% uptime. If a Service Level Agreement (SLA) is offered, it will be limited to specific services and measured over a rolling monthly period. Compensation for SLA breaches is limited to service credits only.
The handling of your personal data is governed by our Privacy Policy in accordance with Indian laws including the IT Act, 2000 and applicable data protection regulations. By using our services, you consent to the collection, storage, and use of data necessary for service provision and compliance purposes. We may disclose personal data if required by law or legal process.
Under no circumstances shall Imageleet, its officers, employees, or affiliates be liable for indirect, incidental, consequential, or punitive damages, including but not limited to loss of data, revenue, or goodwill, arising out of or relating to the use or inability to use our services. Liability in any case shall be limited to the fees paid by the Customer in the three months preceding the event giving rise to the claim.
You agree to indemnify, defend, and hold harmless Imageleet and its affiliates from any and all claims, damages, liabilities, costs, and expenses arising from your use of the Services, your violation of these Terms, or your infringement of any third-party rights.
We shall not be held liable for any failure or delay in performance due to events beyond our reasonable control including but not limited to acts of God, natural disasters, strikes, war, terrorism, embargoes, government actions, Internet outages, or infrastructure failures.
These terms are governed by the laws of India. Any dispute shall be subject to the jurisdiction of the courts located in [Insert City, India]. The parties expressly agree to resolve disputes through arbitration or conciliation as applicable under the Arbitration and Conciliation Act, 1996.
We may revise these Terms at any time. Updated versions will be published on our website. Continued use of the Services after changes constitutes your acceptance of the revised Terms.
If any part of these Terms is held to be unenforceable, the remaining portions will remain in full force and effect. No waiver of any breach or default shall be deemed a waiver of any preceding or subsequent breach.
